Terms of Service

1. Agreement

These Terms of Service (“Terms”) are a contract between you and HK DTS LLC (“HK DTS”, “we”, “us”), a limited liability company registered in Wyoming, United States, for HKFlows (the “Service”) and this website. By creating an account, ticking the acceptance box or connecting an Etsy shop or Pinterest account you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service for a business, you confirm you can bind that business, and “you” means that business.

2. The Service

HKFlows connects to your Etsy shop and Pinterest account. It audits your Etsy listings, suggests SEO improvements that you review and apply to your listing yourself (and can revert), shows keyword research, provides an AI assistant that proposes actions you confirm, drafts Pin content, and publishes approved Pins to Pinterest through Pinterest’s official API.

HKFlows publishes only organic Pins of your own Etsy listings, and each Pin links to the matching listing on Etsy. It does not buy or manage ads, does not use any advertising API and does not send Etsy data to any advertising or marketing platform.

You approve what is published: nothing is scheduled or published until you approve it. You can cancel a scheduled pin at any time before it is published.

We may add, change or remove features. We give at least 30 days’ notice before discontinuing the Service or a platform connection, unless a platform forces an earlier change.

3. Eligibility and your account

• You must be at least 18 and able to enter into a binding contract.
• Connect only Etsy shops and Pinterest accounts you own or are authorized to manage, and only through the platforms’ official authorization.
• Keep your credentials confidential. You are responsible for activity under your account.
• Give accurate information and keep it up to date.

4. Plans, limits and billing

Plans and prices are shown on our pricing page. Each plan sets how many Pinterest accounts and Etsy shops you can connect, how many pins each account can publish per day, and a monthly total. Limits are reserved when you schedule a pin, checked again when it is published, and released if the pin is canceled or fails permanently. Daily limits exist to keep your accounts safe from spam-like behavior and cannot be bypassed.

Plans also include a monthly pool of AI credits (for AI suggestions, assistant replies and the Pin texts of plans) and daily allowances such as keyword lookups; the amounts are shown on the pricing page. Editing a listing by hand and applying or reverting a change does not use credits. Because Etsy limits how many requests our application may make, we may slow down or queue synchronization and keyword lookups when limits are reached.

• Free plan. An Etsy shop or Pinterest account that has ever been used for a free workspace cannot be used for another free workspace.
• Paid plans. Subscriptions renew every billing period until you cancel. Cancel any time in the billing settings; you keep the plan until the end of the period you paid for.
• Credits and quotas. AI credits and monthly quotas reset at the end of each plan period and do not carry over. The free plan’s period starts on the day of the month you signed up. Trial credits granted at sign-up expire 30 days after they are granted.
• Changes to plans and prices. HK DTS may change plan limits, included credits and prices. A change applies from your next billing period, after we notify you by e-mail at least 30 days in advance; a paid period that has already started is not reduced. You can cancel before the change takes effect.
• Missed windows. A pin that could not be published within its grace period after the scheduled time is marked as failed and is not published later in bulk; its quota is released.

Paddle is our Merchant of Record. Orders for paid plans are placed with and processed by Paddle.com Market Limited (and its affiliates), which handles payment, invoicing, sales tax and VAT and which is responsible for refunds under our Refund Policy. Paddle’s buyer terms apply to your purchase. Prices are shown before tax unless stated otherwise; Paddle adds the taxes that apply in your country at checkout.

5. Your content and responsibilities

You keep all rights to the listings, images, text and other content you provide or publish through the Service (“Your Content”). You grant HK DTS a non-exclusive, worldwide, royalty-free license to store, process, display and transmit Your Content solely to operate the Service for you, including sending it to Pinterest and to the AI providers described in the Privacy Policy.

You are solely responsible for Your Content and for what is published on your approval. You confirm that:

• You have the rights needed to publish Your Content, and it does not infringe anyone’s copyright, trademark, privacy or other rights.
• Your Content and your use of the Service follow the terms and content policies of Etsy and Pinterest.
• You will disclose paid partnerships and other commercial relationships where required by a platform or the law.
• AI-generated suggestions are drafts. You review them for accuracy, compliance and suitability before approving them, and you use any AI-disclosure options a platform requires.

If you share a layout in the gallery, you grant other HKFlows members a non-exclusive, worldwide, royalty-free license to use that layout design (not your photos, logo or listing data). Shared layouts pass an automatic check and we may remove any layout that breaks these Terms. You can delete a layout or, on plans that allow it, make it private.

6. Third-party platforms

The Service works through the official APIs of Etsy and Pinterest, which are separate services with their own terms that you must follow:

• Etsy: Etsy Terms of Use and Etsy’s seller policies.
• Pinterest: Pinterest Terms of Service and Community Guidelines.

HK DTS is not affiliated with, endorsed or certified by Etsy or Pinterest. Platforms can change or withdraw their APIs, rate limits or policies at any time. A feature that depends on a platform may stop working as a result, and a platform may suspend your account or revoke our access; neither is a breach of these Terms by HK DTS. Platform data you receive through the Service is for managing your own accounts and may not be scraped, resold or used to build datasets.

Keyword research shows aggregate counts of active Etsy listings for a search phrase. The counts come from the Etsy API, are refreshed at least every 24 hours, contain no personal data, and are for optimizing your own listings only; you may not export, resell or republish them.

7. Acceptable use

You must not:

• Publish spam, misleading or deceptive content, or content that violates a platform’s policies or the law, including AI-generated content that misrepresents products or impersonates people.
• Circumvent plan limits, the daily posting limits, the free-plan rules or the approval step, for example by creating several accounts for the same shop.
• Connect an account you are not authorized to manage or share access tokens or credentials.
• Reverse engineer, probe, overload or disrupt the Service, or access it other than through the interfaces we provide.
• Use the Service to collect data about other people.

8. Privacy and data processing

Our Privacy Policy explains how we handle personal data and forms part of these Terms. For personal data contained in Your Content we act as your processor; the processing terms are available on request at [email protected] and apply to business customers subject to data protection laws that require them.

9. Disclaimers

DISCLAIMER: THIS APPLICATION IS SOLELY PROVIDED BY HK DTS LLC (THE "APPLICATION DEVELOPER"). YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT. THE SAME APPLIES TO PINTEREST, INC.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT AI SUGGESTIONS WILL BE ACCURATE OR IMPROVE YOUR TRAFFIC OR SALES, OR THAT PINTEREST WILL ACCEPT OR KEEP ANY PIN PUBLISHED THROUGH THE SERVICE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HK DTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, SALES OR DATA, OR PLATFORM ACCOUNT SUSPENSIONS, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR 100 US DOLLARS IF YOU PAID NOTHING.

Nothing in these Terms limits liability that cannot be limited by law, or mandatory rights you have as a consumer. Where you use the Service for your business, you agree to indemnify HK DTS against third-party claims arising from Your Content or your breach of these Terms or of a platform’s terms.

11. Suspension and termination

You can disconnect any account or delete your HKFlows account at any time. We may suspend or terminate access if you breach these Terms, if a platform requires it, to protect the Service or other users, or if we discontinue the Service. A suspended workspace cannot schedule new pins and its scheduled pins are not published. On termination we delete your data as described in the Privacy Policy. Sections 5, 6, 9, 10, 12 and 13 survive termination.

12. Changes to these Terms

We may update these Terms. We post the new version here with a new effective date and version, and notify you by e-mail or in the app at least 14 days before material changes take effect (30 days for changes to fees). Continuing to use the Service afterwards means you accept the new Terms.

13. Governing law and language

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules, and the courts of Wyoming have exclusive jurisdiction, except where the mandatory consumer-protection law of your country of residence gives you other rights. These Terms are written in English; translations are provided for convenience and the English version prevails if they differ.
